RUE “Republican Central Securities Depository”, in accordance with the requirements of the Decree of the President of the Republic of Belarus of 15.10.2015 № 422 “On submission of information to the foreign tax authorities” (further – Decree № 422), for the purpose of status verification for a foreign organization or a foreign individual, informs on the need for filling approved by RUE “RCSD”  Depositor’s Identification Forms,  for organizations and individuals, that have applied for opening a depository account (contract settlement).

If there are any interstate or intergovernmental agreements of the Republic of Belarus (further – Agreements), providing the presentation of information about depository accounts (contracts) to the tax authorities of foreign country, foreign organizations or foreign individuals fill the forms, mentioned in Agreement and give them to RUE “RCSD”.

Organizations and (or) individuals – residents of the USA, and individuals having a residence permit in the USA, have to fill in the following document form  (Forms W-8, W-9), are available at Internal Revenue Service web-site http://www.irs.gov

Please, pay attention, that in accordance with the paragraph 1.4. of the  Decree № 422, RUE “RCSD” may:

• refuse to open a depository account (settle a contract) for foreign organizations or foreign individuals, if they refuse to fill in the registered forms (if the registered forms are not filled in within 60 working days following the date of the request);

• unilaterally refuse to execute the concluded contract, when the client refuses to tender documents and information, that are necessary for secure fulfillment of commitments under the Agreement, and (or) if the client refuses to fill in the registered forms (if this documents and information are not provided and registered forms are not filled in within 60 working days following the date of the request), when  RUE “RCSD” has  documented reasons to consider that the client is a foreign organization or a foreign individual, if contract execution will lead to unavailability of the commitments under the Agreement  fulfillment;

• unilaterally refuse to execute the concluded contract, when the owner of the depository account (client under the contact) refuses to set the seal on giving an information (if such agreement is not provided within 60 working days following the date of the request).
